Terms & Conditions
By using Phylex, the user agrees to strictly comply with the following Terms and Conditions. If you violate or attempt to violate these Terms, you may face temporary or permanent restrictions or other actions. Please note that this agreement is subject to change at any time without notice. It is the responsibility of the Phylex Customer to regularly review the terms of use and ensure compliance with them.
Payments
- If there is no payment within the stipulated period (3 days), the Company will suspend the service and then the service will be permanently deleted.
- The services are rendered exclusively on the terms of full prepayment. Upon confirmation of payment, the Company undertakes to provide access to the service within a period not exceeding 3 working days.
- When making a payment it is possible to charge additional commission set by intermediaries and payment systems. The amount of such commission is determined by the respective services and is not regulated by the Company.
- In case of non-payment the server and all its data will be irrevocably deleted: in 3 days for game servers, in 6 days for VDS with payment for more than a month, in 24 hours for daily VDS and dedicated servers. The company is not responsible for data loss in case of server deletion due to overdue payment.
- Dedicated servers shall be provided within 2 (two) business days from the moment of payment confirmation. In individual cases, if the server requires additional configuration or there is a fee for installation, the period of provision may be extended due to the need to prepare the equipment.
- Subnet provisioning usually takes no more than 2 days. However, there are cases when there are no free IP addresses available. In such cases we order additional addresses, which usually takes up to a week. They will be provided in case of placing an order.
The Service Provider shall not be liable
- The hosting provider is not responsible for the software placed by the client on the server. All responsibility for the content, legality, security and compliance of the hosted software with current legislation rests entirely with the client.
- Nor is it responsible for the stability and performance of the operating system installed on the server, or for any failures, errors or problems associated with its configuration, updates and maintenance.
Termination of services
If a user is included in this list, the service automatically blocks the possibility of creating new services. In case of an attempt to bypass the blocking by creating a new account and if it is found that it is linked to a previously blocked user, the new account is also subject to blocking and blacklisting.
- If a customer provides knowingly false information, including the use of third party payment data without their consent, they will be blacklisted. Payments made through Cryptomus are excluded. However, this rule remains in force for payments made by bank cards and through SEPA.
- The service reserves the right to add the client to the blacklist without obligatory explanation of reasons, if it considers it necessary. This decision may be made based on internal rules, analysis of payment activity, suspicious activity or other factors that, in the opinion of the Service, may pose a risk. The customer has no right to challenge this decision, and their account, as well as any related services, may be blocked without prior notice.
- One of the reasons for blacklisting a client may be the posting, distribution or otherwise facilitating the distribution of pornographic content in any form. This includes, but is not limited to, publishing images, videos, text materials, as well as placing links to third-party resources containing such content. The service reserves the right to independently determine whether any material falls under this rule and take appropriate action without necessarily explaining the reasons.
- We value our employees and strive to provide a comfortable working environment for them. In this regard, any improper communication with Company representatives, including, but not limited to, the use of profanity, insults, threats, or the dissemination of false or defamatory information about the Company, its activities or employees, is considered a breach of the terms of co-operation. We expect our customers to maintain a businesslike and respectful tone in communication. In case of violation of this rule, the service reserves the right to refuse to provide services, as well as, if necessary, to blacklist the client without necessarily explaining the reasons.
Prohibited content and software
- It is strictly prohibited to host services (including paid or private access) that can facilitate illegal activities on the Internet.
- Hosting, linking to, or advertising pornography, including explicit adult content, is not allowed.
- The use of network scanners, proxy checkers, and similar software is strictly forbidden.
- Mass email distribution is prohibited unless explicitly authorized by the Company.
- Hosting cryptocurrency mining software or any related applications is not permitted.
- The deployment of software for (D)DoS attacks, port scanning, or similar malicious activities is strictly prohibited.
- Engaging in illegal activities such as carding, cryptocurrency mining, or DDoS attacks will result in the immediate suspension or permanent termination of all account services.
- If a client repurposes the service for hacking, carding, or port scanning, their server will be permanently frozen with no possibility of reactivation.
- If a client uses the server for C2 control, botnets, malware distribution, or spreading viruses, trojans, worms, or other malicious software, their account will be immediately suspended with no possibility of recovery.
Rules of use (Game)
- The placement and use of proxy servers on servers provided as part of game hosting is strictly prohibited, regardless of the selected tariff plan. This restriction applies to both free and paid tariffs.
- Users are prohibited to install, run or otherwise use kernels and software solutions that simulate the operation of the operating system inside the server, including, but not limited to, virtual machines, containerisation and other environment emulation technologies. This prohibition applies to all tariff plans, regardless of their cost, and is due to the need to ensure stable operation of servers, protection from unauthorised use of computing resources, as well as compliance with the hosting provider's policy.

- We keep our customers informed through all available and intended sources of information, including but not limited to: email, personal account notifications, official website pages, social media postings, and other communication channels specified in the service agreement.
