Terms of Usage & Conditions

By using Phylex, the user agrees to strictly comply with the following Terms and Conditions.

If you violate or attempt to violate these Terms, we may apply proportionate temporary or permanent restrictions or take other reasonable actions. We may update these Terms from time to time. Material changes will be published on the website and, where appropriate, notified through reasonable service communication channels before they take effect, unless immediate changes are required for legal, security, or abuse-prevention reasons.

Payments

If payment is not received within the applicable period, the Company may suspend the service and may later delete the service in accordance with the applicable product lifecycle and operational retention rules after a reasonable non-payment period.

The services are rendered exclusively on the terms of full prepayment. Upon confirmation of payment, the Company undertakes to provide access to the service within a period not exceeding 3 working days.

When making a payment it is possible to charge additional commission set by intermediaries and payment systems. The amount of such commission is determined by the respective services and is not regulated by the Company.

In the event of non-payment, the relevant server or service may be suspended and later deleted after the applicable grace period. Different products may have different suspension or deletion timelines depending on the tariff and billing period. Customers are responsible for maintaining their own backups. Nothing in this clause limits any remedy required by applicable law where the issue results from the Company's own fault.

Dedicated servers shall be provided within 2 business days from the moment of payment confirmation. In individual cases, if the server requires additional configuration or there is a fee for installation, the period of provision may be extended due to the need to prepare the equipment.

Subnet provisioning usually takes no more than 2 days. However, there are cases when there are no free IP addresses available. In such cases we order additional addresses, which usually takes up to a week. They will be provided in case of placing an order.

Account balance top-ups are advance payments that may be used exclusively to pay for the Company's services.

The account balance is not a bank account, payment wallet, electronic money, or a store of value, and may not be withdrawn, transferred, exchanged, or cashed out, except where required by applicable law or expressly approved by the Company in its sole discretion.

The Customer must verify the top-up amount before confirming payment. Mistakenly entered amounts, including payment amount errors, are not refunded automatically and are reviewed individually. Unused balance is non-refundable unless applicable law requires otherwise.

Auction rules

Firstly, when an auction is created, a bid requires the required amount of votes. This shows audience interest in the auction case.

If you make a bid and your bid is confirmed, you must pay the resulting invoice. Ignorance of the rules does not relieve you of responsibility. If an auction item is not paid for within 24 hours, ISPLABS LIMITED may restrict access to Phylex services associated with the Customer's account. Active services may be temporarily suspended until the invoice is paid, subject to applicable law and the service terms.

Server Delivery Policy. Server delivery typically takes up to 5 minutes. However, during periods of high order volume or if you selected a custom configuration, delivery may take several business days.

Auction Server and Refund Policy. Server delivery times may vary depending on current demand. If there is a material delivery delay attributable to the Company, the Customer may contact support for review under the Refund Policy and applicable law.

Bidding thresholds. Your bid should be at least €1.00 more than the minimum one. If you bid 200% of the minimum bid, your bid will win.

Overdue Policy. 1 day - €1.00

Account Eligibility and Security

The Customer must have legal capacity to enter into the agreement under the law applicable to them. Where that law requires consent or participation by a parent, guardian, or other authorized representative, the Customer must obtain it before registering or ordering services.

Account access, passwords, passkeys, API credentials, recovery codes, and other authentication information must be kept confidential and used only by authorized persons.

The account may not be sold, assigned, shared, or transferred to another person without the Company's prior written approval. If an unauthorized transfer or sharing is detected, the Company may suspend or terminate the account and all associated services while the matter is investigated.

The Customer is responsible for activity performed through their credentials until the Company is notified of suspected compromise. Suspected unauthorized access, credential disclosure, or account compromise must be reported promptly through the support system or to abuse@phylex.net.

Renewal, Expiry, and Deletion

Automatic renewal may be enabled or disabled when ordering an eligible service and may later be changed from the service list through the Edit action. The Customer remains responsible for checking the renewal setting, account balance, invoice status, and service expiry date.

If a service is not renewed, it may be suspended at expiry and permanently deleted approximately two to three days later, subject to the product's displayed lifecycle and technical processing time. Customers must maintain independent backups before expiry.

Once a service has received Deleted status and its resources or data have been permanently removed, restoration is not possible. The Company does not guarantee recovery from operational backups after deletion.

Fair Use & Network Policy

All services are provided under a Fair Use policy. Short-term traffic bursts are permitted, but the service is not intended for constant line-rate bandwidth consumption unless this has been separately agreed.

If a client consistently generates sustained high traffic and continuously consumes network capacity, we reserve the right to limit the port speed to 10-80 Mbits or suspend the service to protect overall network stability and fair resource distribution.

If you require guaranteed and constant network utilization, you may purchase the IP TRANSIT service separately. IP TRANSIT is intended for customers who need guaranteed bandwidth usage on agreed terms.

Service Levels and Availability

The standard Network SLA is 99.9% availability, subject to the measurement rules, exclusions, maintenance, upstream dependencies, and service-specific terms applicable to the relevant product.

The standard Infrastructure SLA is 99.5% or higher, subject to the same applicable measurement rules and exclusions.

The operational target uptime is 99.95% or higher. A target is an operational objective and is not, by itself, a guarantee of uninterrupted service or an automatic entitlement to service credits or compensation.

Any service credits, compensation, measurement window, exclusions, or enhanced SLA apply only where expressly stated in the selected tariff, order, or separate written service agreement. Planned or emergency maintenance, force majeure, attacks, Customer configuration, and third-party or upstream failures may be excluded where permitted by the applicable terms and law.

Special Conditions

If a tariff has the Special Conditions icon, it means that separate conditions or internal rules may apply to that tariff. Please clarify this information before purchase through the official communication channels.

The Service Provider shall not be liable

The hosting provider is not responsible for the software placed by the client on the server. All responsibility for the content, legality, security and compliance of the hosted software with current legislation rests entirely with the client.

Nor is it responsible for the stability and performance of the operating system installed on the server, or for any failures, errors or problems associated with its configuration, updates and maintenance.

Termination of services

If a user is included in this list, the service automatically blocks the possibility of creating new services. If an attempt is made to bypass the blocking by creating a new account and it is found to be linked to a previously blocked user, the new account is also subject to blocking and blacklisting.

If a Customer knowingly provides false information or uses another person's payment, bank, card, or wallet credentials without authorization, the Company may restrict or terminate the account and services and report relevant activity where required. This rule applies regardless of the payment method, including cards, bank transfers, SEPA, T-Bank, Stripe, and cryptocurrency payments.

The service may restrict, suspend, or terminate accounts where there are reasonable grounds related to fraud, abuse, unlawful use, security risks, repeated payment issues, or material breaches of these Terms. Where reasonably possible and lawful, the Company will provide notice or a short explanation through available communication channels, and the Customer may contact support to request review of the decision.

One reason for restriction or termination may be posting, distributing, or otherwise facilitating prohibited adult or pornographic content where this is not permitted under the applicable service rules, law, upstream provider requirements, or payment provider requirements. The Company may assess the relevant facts in good faith and take proportionate action where necessary.

We expect respectful communication with Company representatives. Threats, harassment, abusive conduct, doxxing, or clearly unlawful defamatory statements may be treated as a breach of cooperation terms and may result in proportionate service restrictions or refusal of further service where reasonably necessary to protect staff, operations, or legal rights.

Rules of use (Game)

The placement and use of proxy servers on servers provided as part of game hosting is strictly prohibited, regardless of the selected tariff plan. This restriction applies to both free and paid tariffs.

Users are prohibited from installing, running or otherwise using kernels and software solutions that simulate operation of an operating system inside the server, including virtual machines, containerization and other environment emulation technologies. This applies to all tariff plans and is required to ensure stable server operation, protect from unauthorized computing resource use and comply with hosting provider policy.

Governing Law and Disputes

These Terms and the contractual relationship with ISPLABS LIMITED are governed by the laws of England and Wales, without excluding mandatory rights that apply to a consumer under the law of their habitual residence.

The courts of England and Wales have jurisdiction over disputes, except that a consumer may bring or defend proceedings in another court where mandatory applicable law permits or requires it.

Before starting formal proceedings, the parties should first attempt to resolve the matter through the support system or the contact details published on the website. Nothing in this clause prevents either party from seeking urgent relief or using a mandatory complaint, payment-dispute, or regulatory procedure.

Prohibited content and software
  • It is strictly prohibited to host services, including paid or private access, that can facilitate illegal activities on the Internet.
  • Hosting, linking to, or advertising pornography, including explicit adult content, is not allowed.
  • The use of network scanners, proxy checkers, and similar software is strictly forbidden.
  • Mass email distribution is prohibited unless explicitly authorized by the Company.
  • Hosting cryptocurrency mining software or any related applications is not permitted.
  • The deployment of software for DDoS attacks is strictly prohibited.
Informing Customers

We keep our customers informed through all available and intended sources of information, including email, personal account notifications, official website pages, social media postings and other communication channels specified in the service agreement.
